2. Scope and Acceptance
These Terms and Conditions of Sale ("Terms") govern all purchases made on the DENSÏA website (densia.co) and any related digital properties (the "Site"). By placing an order, you confirm that you have read, understood, and accepted these Terms in their entirety.
These Terms apply to all customers purchasing from the Site, regardless of their location. They are governed simultaneously by French law (as DORIAN E-SHOP is a French legal entity subject to EU consumer protection regulations) and by applicable United States federal and state consumer protection laws (as the Site sells exclusively to customers located in the United States).
If you do not agree to these Terms, do not use the Site or place an order.
3. Products
3.1 Product Description
DENSÏA Batana Hair Oil is a cosmetic hair and scalp oil formulated with two botanical ingredients: Raw Batana Oil (Elaeis Oleifera Kernel Oil) and Rosemary Oil (Rosmarinus Officinalis Leaf Oil), under the proprietary DENSÏPLEX™ complex.
Format: 30ml amber dropper bottle. Recommended daily use: ½ dropper morning and ½ dropper at night (1ml/day = 30-day supply per bottle).
3.2 Cosmetic Classification and Regulatory Disclaimer
DENSÏA Batana Hair Oil is a cosmetic product as defined by the U.S. Food and Drug Administration (FDA). It is NOT a drug, a medical device, or a dietary supplement.
This product has not been evaluated by the FDA. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition, including but not limited to androgenetic alopecia, alopecia areata, or any other form of medically diagnosed hair loss.
The product is manufactured by a facility certified under Good Manufacturing Practices for Cosmetics (GMPC) and ISO 22716.
3.3 Product Availability
All orders are subject to product availability. DENSÏA reserves the right to limit quantities or discontinue products at any time. In the event that a product becomes unavailable after your order is placed, you will be notified and offered a full refund.
4. Pricing and Payment
4.1 Prices
All prices are displayed in US Dollars (USD) and include any applicable fees unless otherwise stated. Prices do not include applicable sales tax, which may be charged depending on your state of residence and applicable law.
Current pricing:
- One-time purchase (1 bottle, 30-day supply): $49.95
- Monthly subscription (1 bottle/month): $39.95/month (20% savings)
- 3-month subscription bundle: $79.95 (equivalent to $26.65/bottle)
DENSÏA reserves the right to modify prices at any time. Prices applicable to your order are those displayed at the time of purchase confirmation.
4.2 Payment Methods
We accept all major credit and debit cards (Visa, Mastercard, American Express, Discover), Apple Pay, Shop Pay, and PayPal. Payment is processed securely through Shopify Payments. DORIAN E-SHOP does not store your full payment card details.
4.3 Currency and International Transactions
All transactions are processed in USD. If your bank account is denominated in a different currency, your bank or card issuer may apply a currency conversion fee. DORIAN E-SHOP is not responsible for such fees.
5. Subscription Terms
5.1 How Subscriptions Work
When you select a subscription option, you authorize DENSÏA to charge your payment method automatically at the frequency you selected (monthly or every 3 months) until you cancel. Your first charge occurs at the time of purchase. Subsequent charges occur on the same calendar day of each billing cycle.
You will receive an email notification before each renewal charge. Subscriptions renew automatically until cancelled.
5.2 Subscription Consent
By selecting a subscription at checkout and completing your purchase, you expressly consent to recurring charges as described. This consent is separate from your agreement to these Terms and is specifically required for the recurring billing feature.
We maintain a record of your subscription consent as required by applicable law.
5.3 Cancellation
You may cancel your subscription at any time, with no penalty and no cancellation fee. Cancellation must be completed before your next scheduled billing date to avoid being charged for the following cycle.
To cancel, you may:
- Log into your account on densia.co and cancel directly from your subscription dashboard
- Email contact@densia.co with the subject line "Cancel Subscription" and your order number
Cancellation takes effect immediately upon confirmation. You will retain access to any product already shipped and paid for. We will not charge your card after cancellation is confirmed.
Per applicable consumer protection law, the cancellation process is designed to be as simple as the sign-up process.
5.4 Subscription Modifications
You may pause, skip a shipment, or change your subscription frequency at any time by logging into your account or contacting customer service. Changes take effect on your next billing cycle.
6. Orders and Order Confirmation
An order is confirmed when you receive an order confirmation email from DENSÏA. This email constitutes our acceptance of your offer to purchase.
DENSÏA reserves the right to cancel or refuse any order for legitimate reasons, including but not limited to: suspected fraud, payment failure, unavailability of stock, or error in pricing. In such cases, you will be notified promptly and any charge will be fully refunded.
Please review your order carefully before submitting. Once an order is placed, modifications may not be possible if the order has already entered processing.
7. Shipping and Delivery
7.1 Shipping Zone
DENSÏA ships exclusively within the United States (excluding U.S. territories unless otherwise specified at checkout).
7.2 Shipping Costs
Free standard shipping is offered on all orders. Expedited shipping options may be available at additional cost at checkout.
7.3 Delivery Times
Standard orders are typically processed within 1–2 business days. Standard shipping transit time is 7 to 12 business days depending on your location. These are estimates and not guaranteed delivery dates.
DENSÏA is not responsible for delays caused by carriers, weather events, customs processing, or other circumstances outside our reasonable control.
7.4 Shipping Confirmation
You will receive a shipping confirmation email with tracking information when your order is dispatched. Risk of loss and title for products purchased pass to you upon delivery to the carrier.
7.5 Lost or Damaged Shipments
If your order is lost in transit or arrives damaged, please contact us at contact@densia.co within 14 days of the estimated delivery date. We will work with the carrier to resolve the issue and, where appropriate, reship your order or issue a refund.
8. Right of Withdrawal (EU Customers) and Returns
8.1 EU Statutory Right of Withdrawal
As DORIAN E-SHOP is a French entity subject to EU consumer law, EU-based customers (if any) have the right to withdraw from a purchase within 14 calendar days of receiving the product, without providing a reason. To exercise this right, contact us at contact@densia.co within the 14-day period.
Note: This Section 8.1 applies to customers located in the European Union or European Economic Area. All other customers (including US customers) are governed by Section 9 (Money-Back Guarantee).
8.2 US Return Policy
For US customers, returns are governed exclusively by our 90-Day Money-Back Guarantee (Section 9). Outside the guarantee terms, all sales are final.
9. 90-Day Money-Back Guarantee
9.1 Our Commitment
DENSÏA stands behind DENSÏPLEX™. If you use the product consistently as directed for 90 days and are not satisfied with the results, we will refund your purchase price in full.
9.2 Eligibility Conditions
To be eligible for a refund under this guarantee, ALL of the following conditions must be met:
- You are a first-time DENSÏA customer (one guarantee claim per household)
- The product was purchased directly on densia.co (not through a third-party retailer or marketplace)
- You have used the product consistently as directed — ½ dropper morning and ½ dropper at night — for a minimum of 30 consecutive days prior to submitting your claim
- Your refund request is submitted within 90 days of your original purchase date
- You contact our customer service team at contact@densia.co before returning any product, to initiate the process
- The product was not purchased for resale or professional use
9.3 How to Request a Refund
To initiate a guarantee claim:
- Email contact@densia.co with the subject line "90-Day Guarantee Claim"
- Include your order number and the email address used at purchase
- Briefly describe your experience
Our team will respond within 2 business days. We may ask follow-up questions to better understand your experience and improve our product. We will not request photographic evidence as a condition of your refund.
Approved refunds are processed within 10 business days to the original payment method.
9.4 Exclusions
The guarantee does not apply to:
- Purchases made more than 90 days prior to the claim date
- Customers who have previously received a refund from DENSÏA
- Products purchased through unauthorized resellers
- Orders placed with fraudulent payment information
- Subscriptions where more than one billing cycle has been charged and not disputed within 30 days
9.5 Subscription Refunds
For subscription orders, the 90-day guarantee applies to your first shipment only. Subsequent subscription charges that were not cancelled before the billing date are non-refundable, except in cases of billing error or unauthorized charge.
10. Product Disclaimers and Health Information
DENSÏA Batana Hair Oil is a topical cosmetic product. By purchasing and using this product, you acknowledge and agree that:
- This product is not a substitute for professional medical advice, diagnosis, or treatment
- Individual results vary and are not guaranteed. Factors including hair type, scalp condition, consistency of use, hormonal status, and overall health affect outcomes
- If you have a diagnosed medical condition affecting your hair or scalp, or are pregnant, breastfeeding, or taking medication, consult your physician before use
- Discontinue use and consult a healthcare professional if you experience irritation, rash, or adverse reaction
- Keep out of reach of children. For external use only. Avoid contact with eyes
- Studies referenced in our marketing materials relate to the individual botanical ingredients (rosemary oil, batana oil) and not to DENSÏA as a finished, tested product
11. Intellectual Property
All content on the Site — including but not limited to text, images, logos, product names, the DENSÏPLEX™ trademark, and the DENSÏA brand identity — is the exclusive property of DORIAN E-SHOP or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or use any content from the Site without our prior written consent. Any unauthorized use may result in legal action.
12. Limitation of Liability
To the fullest extent permitted by applicable law, DORIAN E-SHOP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your purchase or use of the product, including but not limited to loss of profits, loss of data, or personal injury.
Our total liability for any claim arising from a purchase shall not exceed the amount you paid for the specific product giving rise to the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal proceeding, we encourage you to contact us at contact@densia.co to attempt to resolve any dispute informally. We will make reasonable efforts to resolve concerns within 30 days of receiving your complaint.
13.2 Governing Law
These Terms are governed by the laws of France, as DORIAN E-SHOP is a French entity. However, mandatory consumer protection provisions of the law of your state of residence in the United States also apply where they provide you with greater rights.
13.3 Jurisdiction
For disputes that cannot be resolved informally, French courts have jurisdiction, except where mandatory provisions of US law provide you with the right to bring proceedings in your local courts.

14. Taxes
DENSÏA may be required to collect sales tax in certain US states where we have a tax nexus. Applicable taxes will be calculated and displayed at checkout. Tax rates may vary by state and locality.
As a French SASU selling to US customers, DORIAN E-SHOP complies with applicable VAT regulations in France. US customers are not subject to French VAT.
15. Privacy
The collection and processing of your personal data in connection with purchases on the Site is governed by our Privacy Policy, available at densia.co/pages/privacy-policy. By placing an order, you confirm that you have read and accepted our Privacy Policy.
16. Changes to These Terms
DENSÏA reserves the right to update these Terms at any time. The updated version will be posted on the Site with a revised "Last Updated" date. Changes take effect upon posting.
For material changes affecting your rights, we will notify you by email where we have your address. Your continued use of the Site or placement of new orders after such changes constitutes acceptance of the updated Terms.
Orders placed before a change takes effect are governed by the Terms in force at the time of purchase.
